Breach of Contract — Commercial Tenant vs. Landlord
Represented the operator of a regional retail business who had entered a 10-year commercial lease on a prime location. Eighteen months into the lease, the landlord anticipating a more lucrative redevelopment opportunity began a systematic campaign to force early termination: withholding agreed infrastructure upgrades, failing to maintain essential building systems, and ultimately cutting utility services without notice. Our client was forced to suspend operations for 11 weeks, resulting in significant revenue loss, staff costs, and permanent damage to customer relationships. We pursued breach of contract, tortious interference, and constructive eviction claims.
Outcome
Full judgment in favor of client. Awarded $340,000 in compensatory damages covering lost revenue, emergency relocation costs, and staff expenses during the closure period. Lease was enforced for its remaining term at original rates. Landlord's counterclaim dismissed in its entirety.
